    Leaving the state with my son
    The mother of the child likes to go out to bars all the time and she comes home drunk. Well usually the next day she yell at our 7 month old baby for fussing because she is hungover.ww are not married and I want to take my son and move back to ga from sc what can I do to get him out of this situation as quickly as possible? Thank you.

    Are you on the birth certificate. Have you been idnetified as the legal father?

    If you are the biological father and your name is on the birth certificate you can have the child removed from her care... call CAS

    Are you living together ?
    Are you on the birth certificate?
    If not living together is there a chid custody order in place.

    You will need to file for custody of the child, being allowed to move out of state will be harder, since even if you win custody, it will effect her right to visit.

    Yes I am on the birth certificate and I am the father of the child I need to know if there is any kind of temporary thing so I can take him until a court hearing.

    Well here's the thing. If you are acknowledged as the legal father, and there was no court hearings to determine custody. Then you would can legally move with the child. You would not be charged with kidnapping.

    However, I do not recommend doing that. She can file for custody and the courts may order you to return.

    So my recommendation would be to get an attorney and file for full physical and legal custody. You need to document her alcoholism and abusive nature. Your attorney will tell you what to do along those lines.

    But if you bolt, the courts will not look kindly on it.
