    Claiming my mother as Depedent
    Hi
    My mom was here in US last year for 5 month. When I claim her dependent in my returns, Can I sign W7 form for her or I need to send that to india to get it signed. Please let me know

    A dependent must be U.S. citizen or residnet. Also to claim parent it is not required that they live with you.

    You can claim your parent as dependent (qualifying relative) if 1. You provided more than half of their support, and 2. the parent did not earn more than $3,500 in 2008. Read about Qualifying Relative: : Your U.S. Tax Return: Requirements for claiming a dependent

    Sorry, for parents who are foreign nationals, they must meet the Substantial Presence Test to be claimed as dependents.

    Since your parents were here for only 5 months, they do not qualify.
