    Hipaa violation?
    During a group casual meeting, medical information was disclosed to the group from an individual, is this a hipaa violation? Would this be considered a civil or criminal penalty?

    1. what type of "casual" meeting

    2. what type of medical information

    3. the information was it about others or about hisself.

    4. was the person a medical professional and learned about this info from medical files and patients.

    For example, if you were just having dinner at someone's home, and they told information about thierself, or gossip they heard from others, nothing

    1. Friends-co-workers getting together for the day
    2. info from a past hospital visit
    3. info about another person. Reference was made that a connection with a current event could have been related to the medical event in the past.
    4.yes, medical person who was part of a hospital situation involving the person who she disclosed the information on.

    If this information came from his duties at the hospital, the person whose info was given out, can file a complaint with the hospital. What level of action will be taken against them will depend on the hospital rules and the type of info given and if this info was public or private info ( was it info that would have been publicly available to others anyway_

    Thank you, no not public, it was a private medical situation that only she had knowledge of among the whole group.
    I am deciding whether to take action. From what I have read, there could be major fines and imprisonment. Of course, I would not want this to happen to anyone, its not the chritian attitude to "Fry" someone because of a mistake. But it should have not been spoken of, regardless of the converstion's topic. I am glad you suggested the hospital route, I wasn't sure if I should go to the hospital (in which I work, so does she) or talk to a lawyer.
