Switching child support from one state to the other
Hi All,
I'm going through the child support switch and was wondering why the mother claims I'm less per week than what is actually being deducted from my paycheck. Is there any advantage to this in the court or is it a strategy to get even more from me in the long run? Also she is seeking an adjustment in the support when it was already adjusted a year ago. Can I get this motion to be dismissed? :confused::confused::confused:

What state are you in? States have varying laws on the amount of support you are required to pay.
What grounds does she have for requesting an increase? Has the cost of raising the child increased(i.e.: daycare, school supplies, etc.)?
It doesn't matter what she claims you're paying; what matters is you being able to prove what's being taken out of your check and being sent to Child Support.

I live in NY and child does as well. I don't know what exactly what she is claiming as a cost of living increase but he does do afterschool which I think isn't beneficial to my child because they are extracurricular activities. But what I'm wondering is why she said I give $20 less/week than I do now?

She probably thinks she's going to trick someone, which is stupid of her. This is why the Support Agency was established, so that there's no back-and-forth of "I gave you money; no you didn't; yes I did" going on.
If I can ask, how much are you paying and for how many children?

Well I'm paying 17% for one child. It doesn't make sense for her to try and trick me since it's going from my paycheck straight to her account.
Since this was adjusted last year then is it grounds to have this dismissed?

Some parents file for an increase as soon as the non-custodial parent gets a $.50 raise. It may not seem like much but people are that greedy.

What state were you in when this all went through the courts in the first place and what has happened since then ? ( timeline please )

I thought your question had something to do with "switching states" but there is nothing you said that has to do with different states.
Also, most of everything else you wrote is, and sorry to say this, incoherent.

This is important info - the calculator may require MORE support in NY than it did in NJ.

Well an increase was already done in nj a year ago and my court date is a month away. We are already in the process of switching payments from NJ to NY.
