    TX child custody & fathers rights
    Today my announced that she was moving from our domicile to another location within the state of Texas. She has done this is the past because she had and affair with a married man. I do not know the reason this time. We have a 4 year old son and she has told me she intends to move with him after cleaning out our joint bank account. She is employed and makes less than I do. I have sources of funds available to protect my rights. I want to have custody of my son. Given these circumstances can I realistically obtain custody or will my gender affect my ability to gain custody? If I have the means to provide for daycare while I am at work during the school days and I can keep him in preschool during most days. I am a bit naïve about my rights and how to proceed in this situation. I appreciate your candor and help. Thank you

    Ok, first why don't you clean out the account first? And why don't you go to court ( attorney) tomorrow and file an emergancy motion to give you custody of the child, to restrict her from moving out of the area that would restrict your visits if there was joint custody.

    Once she is moved and gone it is harder to do.

    Thank you for your help. I did the checking accounts yesterday morning. I got appt with attorney on Monday a.m. - it was best he could do. I picked him because he is friends with the judge and he has a very good rep in my county. Thank you for you help - I sincerely appreciate you giving me a kick in the butt to stay focused.

    And while your at it see what you can do to have her removed from the home if she decides to act up either to you or in front of the child.
