    Deposit problems with last apartment
    So here's the story my husband and I lived in a apartment complex for about 3 months in VA when his company moved us out of state we paid 3 months rent to get out of our lease. Well they turned around and are now trying to charge us for GAS utility after we moved out. Two months worth to be exact. They took the money out of our 500 dollar deposit. Also when we moved into the apartment we noticed there were red stains on the floor all through out the apartment. We wrote this down on what they call a move in check list. The manager even saw the red stains before we signed the lease. Now they are taking out 167.50 out of our deposit so we aren't even getting half our deposit back. Should we take legal action against this apartment complex. We have proof that when we moved in there were red stains and we have proof that we were no longer living there for the 2 months they were charging us for those utilities. Do we have a case and should we sue them? If we sue them we will sue them for a lot more then the remainder of our deposit. By the way this is in the state of VA:(

    Hello k:

    I'd sue 'em. The worst that can happen is you lose. The cost to file is only about $50.

    I'd only sue 'em for what you're out, though. If you try to get more, it makes you look as greedy as the landlord does. That ain't going to help your claim.
