:confused:i have physical custody of my daughter but he signed the birth certificate. I have an order of protection that was issued in court for domestic violence against him. How do I get my daughters passport?:confused:

You file for the passport and furnish the required/requested paperwork. Is your "ex" allowed to visit with your daughter or do only you have the restraining order?

You furnish the birth certificate and will need the protective order if you wish to use the passport - otherwise you need the father's signature.

He doesn't have visitation rights and another thing is when he signed the birth certificate he put a false middle name. Does that mean anything?

I don't know why he would do that but he still signed so I would say he's the acknowledged (legal) father.

I also believe you can get your daughters passport with her birth certificate. You didn't mention her age, so I imagined she can't get her own copy. Yes you will need proper identification, usually you can call your county or any currency exchange in your area to inquire about details, prices they charge. Legally though, I believe since you have sole custody, you won't have any problems obtaining a new passport for her, (If her father refuses to give her original to you) perhaps she will have to take a new photo. Be prepared when you call to give and get just the basic information from the currency exchanges. The county will surely let you know if you must supply court orders granting custody, or other legal documents, so obtain official copies, as it is always a good idea to have them your possession, ready to show your authority over your daughter's person. This is not totally correct - if the OP intends to enter Canada (as well as some other Countries) with the child the child needs the signature of both parents. That's why I said she must carry a Court-certified copy of the order of protection.

I don't understand how a currency exchange office is involved. This is a Customs/Immigration matter.
