    NY Non-Resident
    My wife moved from NY to TX in Nov 2008. She has not worked in TX and hence she has no income in TX. Which NY state form should she fill? Resident - Long/Short or Non Resident - Long/Short? Most sites mention that she qualifies under Non-resident as she is not domiciled there and she was in NY for less than 11 months but they mention that she should also fill Part Year Resident form. Turbo Tax has these two forms separately and if I change my wife's status to Part Year Resident then I need to pay a hefty sum to the IRS.

    Also, since all her income was in NY, when the software asks for NY State only wages, should I just put in the same amount as the Federal one a k a Box 16 from her W-2 form? Thanks!

    For 2008, NY is your resident state. So report all your worldwide income for 2008 to NY.
