    Child w/o mother
    My son and ex-daughter in law were married in CA 2005 and divorced CA 8-17-08. There is joint custody of their only child. Dad gets him 6 months, Mom gets him 6 months. The child is 3 yr old now. My son lives in Tacoma, WA.

    Problem is Mom let him go to Dad in June 2008 and Called and talked to their child on his birthday in Oct. 2008 and then called Christmas Day but my son told her that the child was with me visiting with us (Grandparents) for a bit and to call our house but she said no she didn't want to call. That is the last time she has inquired about her son and she did say in Oct that she lived in Louisana but she wouldn't say with who or exactly where at first but she relented and said with who. She is back to living with the man who abused my grandson and alledgely molested him when he was 1yr old. The abuse is certain I was there the molestion the therapist are still working on. She still has not said where in Louisana she is but she is doing adult films and prostution to support herself and her other child who is 1 yr old.

    My question is this abandonment of a child? My son is afraid to rock the boat legally cause he is afraid that the law will look at him as kidnapping his son, he wants to file for full custody but like I said he is afraid. She is vindictive. I have had my grandson on and off since birth when they all lived with me and the mom lived with me up until August 2008.

    He's told the mother that as long as she is with the man she is with now she cannot have her son back due to the abuse from before.

    He need to see an attorney at once and file for full custody. I take it the child is living with the father now. The sooner he files, the better it looks for him. Keeping the child in defiance of a court order of 6 months him 6 months her the longer he keeps the child without filing anything, the worse it looks for him.

    Was the molestation reported to anyone?

    Your son needs to worry more about the child than his wife's reaction. He needs to see an attorney.

    He needs to file in court ASAP for a change in custody, The longer he waits, the harder it is going to get.

    Next you do not kidnap your own child, you can interfere with custody, but that is why he needs to get back to court
