    h1b 2008 tax issue
    Hi,
    I was in usa in Feb 2008 and went back to India for 9 months. I returned back in Dec 2008. I am on h1b visa. Now I got W2 for my 2 months income of 2008. I have following questions
    1) How do I go about filing tax returns?
    2) What is the tax calculation for H1B holders?
    3) Am I resident or Non-resident alien?
    4) Which form should I fill 1040 e-z or 1040n-r or any other?
    5) I heard that since I was here for just only 2 months, I would get back all the federal tax. Is that right? Please help

    Assuming that you were not in the U.S. in 2007, you will file nonresident tax return.
    If your income is less than $3,500 plus your itemized deductions, then you will get the federal income tax withheld back.

    Hi,

    I am in a similar situation - I worked for only 2 months in 2008 on H1B, and now I am outside US.

    Is there a way I can file my non-resident alien federal and state returns electronically? I tried the website File Taxes Online - Do Taxes FREE - File Taxes With TaxACT but I am unable to file electronically. What other options do I have?

    Any help would be highly appreciated. Thanks.

    What form should I use? 1040NR or 1040NR-EZ? I am married with one kid. My was not present in USA during these 2 months. My income for 2 months in 08 is 10776$, Federal tax is 1852$ and State tax 580$. Could you please tell me if I am eligible for any tax return considering my status? Thanks and You are a great help.

    You can file Form 1040NR-EZ

    If you were in the U.S. for only two months, then you will file nonresident tax return Form 1040NR or 1040NR-EZ. It can not be efiled.
