    Filed 1040 EZ for 1040 NR-EZ
    Hello,


    You guys are doing great job in helping all in this forum by giving good advices.My question is I am on F1 student visa from INDIA,I came here in 2006 and filed 2006 and 2007 tax using 1040 NR-EZ by using cintax software.For 2008 I used turbo tax to file my 2008 tax on one of my friends advice and I already got confirmation email that my tax has been accepted by IRS.I graduated in aug-2008 and I am on OPT from OCT -08.Did I do mistake in filing 1040 EZ for 1040 NR-EZ and if I did do I need to correct this mistake in this year or can correct next year.If I did mistake will it have any effect on immigration as I am going to file for H1 this year.Please help in making decision whether to amend the which I am getting or I can correct this mistake next year.Thanks for your help in advance

    For 2008, you must file nonresident tax return if you are not married to a resident.

    You will file amended tax return. For amending your tax return, you must file IRS Form 1040-X with properly done nonresident tax return Form 1040NR or 1040NR-EZ and Form 8843. Column A is what was on the original return, Column C is what should have been there (that is corrected amounts) and Column B is the difference. Complete these columns and then refigure your tax.     Yes, if you do not file amended tax return, it may have effect when applying for H1-B.

    Thank you for your answer... my question is what all columns should I fill in the 1040 X form as because I entered correct AGI in 1040 EZ form.I don't see any of the lines from 1-24 apply to me.The other question is what will be the last date to submit my amended return.What if I get return back before submitting the amended return.Is there any online software to fill 1040 NR-EZ form.Please help me with these answers.

    There is no last date. If you file after April 15, 2009 and owe taxes, you must pay with interest and penalty.
    On 1040X, you must fill all the columns. Go through Form 1040X once again.

    Thank you for your answer... as I am from India I don't owe any taxes in fact I should get the refund back and as I see the refund which I am getting through turbo tax i.e, by filling 1040 EZ form is less then If I file 1040 NR-EZ form.I checked 1040-X and still I don't see any line that applies me as I enter write information about annual gross income in 1040 EZ form.Please advise

    It is possible that, in amending your return from resident to non-resident status, you will owe NO additional tax, but it is unlikely that you will get a refund on the federal income taxes.
