    Not lease agreement no rent! In Florida
    I have a house in Orlando Florida that is owned through my irrevocable trust. During the tough times we decided not to sell until after Christmas this year. (I do not live there. I live in another home.) I let my friend live there instead of it staying empty. I did not have her sign a lease nor did I ask for rent. (again it is owned outright by my trust.) I asked her to keep the yard and pool tidy and clean. She has not fulfilled her agreement on that either. Once the pool was Black with tadpoles and she let my hedges die, and left a huge fulfilled tree lay on the sidewalk and grass after it was blown over during one of our storms this summer.
    I have asked her verbally to leave in the last week of January because my trust advisor wrote me a letter on Jan. 20th stating she wanted her out and that the house be empty to sell it.
    This friend is telling me that she shall leave maybe if she finds a place by march 15th. I am not sure what my rights are to a person who never signed a lease and never paid any rent. To top things off she was on a shared phone plan with me and spent well over 4, 000 dollars in over texting! (true it is partly my fault for not checking the balance but I have auto fulfilled for the phone account and I was out of town away from a computer for the entire summer and then some. Please advise me of what to do. Confused:

    Without a lease she is a periodic tenant. In Florida you can give her 15 days notice to vacate. If she doesn't, you can then file for an eviction.

    I would also sue her for the phone bill and any damages she allowed to occur by not fufilling her end of the agreement.

    However, she could not be held responsible for the tree blowing down.

    As noted, she is a tenant, and treated just like any other renter.
    You just evict her,
