    Effect of bank foreclosure on a lien for home owners associtation dues
    Member of a home owners association in WV. The association filed a lien for dues that are past due. The bank is foreclosing on my home. What is the effect of the foreclosure on the home owners association lien for dues.

    The lien will be behind any other liens. If there is enough money after the property is auctioned off to pay all the liens, they will be paid. If not, the lien holders will need to see what other actions they can take.

    You need to carefully read the bylaws of the association. Certain associations have provisions that extinguish the hoa liens in the event of a foreclosure.
