    Boyfriend holding belongings until I give him 1500.00
    My boyfriend and I have lived together for 6 months now(been together for 3 years) and he kicked me out the house due to finances! He will not allow me to get any of my belongings and is threatening to take me to court for 1500.00. He says that the 1500.00 is for rent and that if I give him 1500.00 I can have my things back.

    Now,
    I moved in with him into an apartment, my name is not on the lease and we never had an agreement about me paying rent. I moved in with him because I was pregnant and could no longer work due to being placed on bed rest. After I miscarried and went back to work, I could only get part time hours but I helped him out with the bills, I gave him 50.00 a month for rent and paid all the utilities, bought all the groceries and other household items, I also helped him with the car(not in my name) always gave him gas money(even though I ride the bus). Now that he is threatening to take me to court, what should I do? How do I go about getting my belongings and does he have a case?

    Call the police who should go with you to get your belongings, ( he can not hold them)

    He can and should sue you in court if you do owe him rent money.

    So even though we never had an agreement, I still owe him?
    We never talked about me paying rent, I gave him my entire check and if he did not put it towards what needed to be paid, and instead purchased shoes and other things like that, how am I responsible?

    No, I don't know who owes who, that is for a court, he will tell his side of the story and you tell your side.

    It gets real fuzzy esp with boyfriend/girlfriend and claim of rental.
    But I am saying he has the right to sue you in court if he claims you owe him.

    And after you go with the police to get your things back, you also have the right to sue him. If you were giving him money you were a tenant. He had to give you 30 days written notice to terminate your tenancy and then he had to file a lawsuit for eviction. He didn't have the right to just kick you out. So you could sue him for illegal eviction.

    Do you have proof of this? Did you endorse the checks to him?

    If you can prove you did this, then you are on solid footing. Go to the police station and see if you can get an officer to accompany you to pick up your belongings. You will have to prove you lived there (mail addressed to you there, drivers license with the address, etc.). If the police will not do this, then get a court order for them to enforce.

    As long as you can prove you were a resident in the apartment then he had no legal right to kick you out nor to hold your belongings. Which means you can sue him and most likely win.

    YES, I received mail there, and I have my bank statements showing my transfers from my account to his account. I also have money order receipts and text messages from him where we have talked about the $ arrangement, lack there of.

    Go to the police, have them escort you there while you get your stuff, and then file a lawsuit against him for illegal eviction. Your damages are your moving expenses and whatever you had to pay as rent for the first 2 months after he kicked you out.
