I want to join the Army but I have a criminal history. The Army says that if I have 1 major crime (Charged with misdemeaner aggravated assault plead guilty to Misdemeaner simple assault) and 3 or more minor offences I can not get a waiver to join the military. My recruiter says there is nothing more he can do and I can not join the Army. What I am asking is. Because I was charged with aggravated assault is that what the Army looks at or is it the Simple assault that I was actually convicted of? Also if it is The Aggravated assault what other course of action can I take to get in? One other thing all of this happened more then 15 years ago. It seemes like the recruiter wanted to tell me something but he could not, like there is something I can do about this but he can't tell me. What can I do to get into the Army?

This may help in explaining a lot of your questions explaining which offenses which may hinder ones joining the U.S. Army. Also, it covers which criminal convictions can and cannot be waived. The best of luck to you. As mentioned with each branch of service, Joining the military is not a right. It is a privilege. Every single branch of the military reserves the right to reject a potential recruit for any reason.

Thanks for the information, however I am still at a loss. I was charged with Midemeaner agrravated assault (which the military sees as felony) but I was convicted of Midemeaner Simple assault (which the military considers a waivable misdemeaner. Every thing I can find and read says CONVICTED of. I am abviously missing something here.

It's NOT the criteria that's important here. It's how the criteria is INTERPRETED. You think the Army should consider what you were CONVICTED of rather than what you CHARGED with.

I understand. I agree with you. But, it's not MY agreement that you need.

What you need to do, is get an answer to your question, but you're not going to get it here.

I'm SURE that the criteria for distinguishing a misdemeanor from a felony IS published by the Army. You're going to need to get a hold of THAT document. Maybe your recruiter can supply it, or you can get it another way.

Once you have that document, then you'll know if you FIT the criteria or you don't. If you DO, then you can appeal their decision, and with the evidence you have, you'll be shooting Afghan poppy farmers quicker than you can bat an eye.

I haven't clarified it for you, I know. But, hopefully I've given you direction where you CAN get it clarified.
