Am I automatically considered a resident for tax purposes after 8 years on an F1?
    Hi all,

I am trying to determine whether I should file 1040EZ or 1040NR-EZ this year, and have been impressed by the quality of responses on this board.

I am a single citizen of the UK and was an F1 student from Sept 1997- June 2001, and again from Sept 2004 - June 2008. I have been F1-OPT since June 2008. I was in the US for >190 days since becoming F1-OPT. Can I file as a resident since I have more than 5 years on an F1 or am I still considered a non-resident for tax purposes?

    Many thanks in advance.

    Mark:

You are a resident alien for tax purposes, and have been since 1 January 2005.

    File Form 1040EZ.
