    Not a resident of either of the states I'm filing in
    I am a resident of Wyoming, but I am a college student in the state of Montana where I work. I also did an internship in Pennsylvania during summer 2008. So, I have two W-2s for Montana and one W-2 for Pennsylvania. I am very confused how I am supposed to file. Montana has state tax and Pennsylvania has state and local tax... but I am not a resident of either of those states. I am a resident of Wyoming, which does not have any state or local tax. Somebody help!

    If you are present in a state, then any income earned during this period, must be reported to the state.

    To your resident state, you must report your worldwide income for the year. Read: Your U.S. Tax Return: Working or Living in Two or More states

    You need to file state income tax returns for Montana and Pennsylvania. In each case, you will file as a non-resident.

    You will report the Pennsylvania income on the Pennsyvania tax return and the Montana income on the Montana tax return.

    If money was withheld, then, more than likely, you will get refunds from each state.

    As for the local taxes in Pennsylvania, those are likely flat taxes which require NO tax return be filed.
