Will Prosicutor have to prove their case and is there a time limit for them to do so?
Hi everyone, I have a question. My cousin was accused of stealing checks from his employer and was terminated. The company reported it to the Somerset county prosecutors office and now they are trying to pursue the matter. My cousin ended up getting a lawyer and was told that he may face 3rd degree theft charges. My cousin never cashed or handled any checks. Its been about 6 months now and we haven't heard anything about any charges. Could it be that the prosecutors office is trying to billed a case? Doesn't the prolocutors office have a certain amount of time to file charges? And if so do they have to prove that my cousin actually stole any checks? My cousin has no criminal record, and has never been in trouble with the law.
I'm new to this post so I am not sure if I provided the right information. Can anyone please give me some good advise?
I also forgot to mention that there is two other people involved that may have committed the crime however my cousin did not have anything to do with it. Please help!!

    Hello C:

The prosecutor has probably 3 years to bring charges, and YES he has to prove his case beyond a reasonable doubt before your cousin has to even open his mouth.
