I have a nonperson felony DUI from 9-08. I disclosed this on a job application but later learned it never showed up on my background check done on me by two different employers. Does this mean since I went through the court system and was convicted, it will not show up on a background check? Or do only "pending" or unresolved cases appear on a background check.

Depending on how thorough a background check a company wants to do and is able to do, you're record of most any kind is likely to be revealed.

Some companies even continue to do background checks after employees have been hired. It might be part of the Human Resource person's job to do just that.

Best to be as honest as you can be if questions about these things do come up.

Thank you, however, an outstanding misdemeanor 2 1/2 years old did show up on my background check since I never went through the court system in Oklahoma where the offense occurred. My dui's were in Kansas and both prospective employers used companies that did a NATIONAL search; nothing showed up in Kansas but the old Oklahoma misdemeanor did. My guess is that the reason is because I already went through the Kansas system, was convicted and served my time, that's why it didn't show up, yet the Oklahoma case did? Makes one wonder if they can get away for not disclosing anything that you have already been to court for, whether paying a fine, time, or whatever.

My suggestions to anyone looking for a job and may have had trouble in the past to pull your own criminal background to know what to say on applications. NEVER lie on an application and another suggestion is to fill out a sample application and keep it on you when going to apply for a job so you know exactly what to say.

There is no ONE way to answer questions because each company is different so you may want to annonomously ask an HR representative their background policy if possible. Some companies only ask for convictions, some only ask for their state, some do not want to know any pending cases or specific crimes.

Do not shoot yourself in the foot before even getting a chance to PROVE what you can do for them!
