Hi There - I am currently on an H1-B Visa and working in NJ. I am also taking graduate school classes on a part time basis at Rutgers Univ, New Brunswick. My question is regarding the fees I am paying for my graduate school.

Even though I have been living in NJ and paying taxes here since 2002, I was told by my grad school that I do not qualify for In state tuition because of my Visa status. I wanted to confirm if this was true or if there is anything I can do to appeal this?

Currently I am paying out of state tuition which is double the amount. Your response for this question is greatly appreciated.

Google search leads me to the following page: Applying: NJ Tuition Eligibility

And it says:

"Other noncitizens who are in the United States on temporary visas (not permitted to establish a legal domicile in the U.S.), such as B, C, D, F, H, I, J, K, L, M, O, R, TD, TN, and NATO classifications, or holders of the Employment Authorization Card, are classified as nonresidents for tuition assessment regardless of how long they have been residing in New Jersey."

I'm also going through the same situation - I'm working(H1B visa status) and staying in NJ for more than a year now and am planning to take graduate school classes on a part time basis at Rutgers Univ, NJ. I'm also being asked to pay out-of-state tuition fees(huge amount) :(

Does anyone on this forum know a way out for this situation?

No.. All non-immigrant visa holders are not eligible for resident rate tuition fee.

To be eligible for resident rate tuition, you must be a green card holder with at least 1 year in US.
