    Can I take my car back?
    I own a car for sale. My husband's friend wanted to buy the car. We sold it to him with a down payment and he was going to make payment to us every pay check(title still in my name). He has not made payment and I would like to know how to seize the car with no help from the police. Also so he can not come back on me.

    Do you have any documentation on the agreement to sell? However, since you never transferred title the car is yours to take back.

    I would, however, make sure you document the lack of payments in case he takes you to court.

    The title is in your name so you can get it.
    You should never give anybody the car before the title goes in their name because if they wreck it or anything YOU are responsible and they decide they do not have to pay since they are not able to use it after all. You tell him that you need your car back and you are more than willing to give him his money back if that is what it takes to keep it peaceful.
    Take the title with you when you go to get it back and it really might be a good idea to take the police or somebody that can make sure he doesn't fight you on this.
