See the whole problem came in when my husband and I had problems and spilt up, but we are trying to fix our marriage. So in August my daughter went to spent the night and my mother in law. So I went out with my sister and brother in law and I had something to drink and then I phoned my mother in law to say good night to my daughter and she heard that I had something to drink, but my thing is that my child was not with me and when she is with me I don't drink.

So I would like to know on what grounds can take my child away. I am working and can support her on my one if I have to, my husband and I live with them at this moment until we can afford a place of our one. And she only have an problem with me and the other dauther in laws.

Unless she has proof you are a danger to your child, such as abuse or neglect, she won't be able to do anything, besides the child's father is there as well.

What does your husband say to all of this? Is he not supporting you and saying something to his mother?

Yes I agree with Doug. She would have to prove a history of being unfit. I know many women who drink regularly and neglect their kids and still have them. She can not prove you are unfit as easily as you can prove she is doing this with spite or malicious intent.
You need to talk with your husband and work together in agreement with how to handle your mother in law and the children's services in case they do get involved.

Does not sound like anything to me,
Next your ex ( I assume your ex) would be the first in line to file for a change in custody.

What type of custody order do you have now.
