    Apartment Lease not signed by tenant
    If a tenant does not sign the lease but continues to live in the apartment and pay rent is the lease considered a month to month lease?

    Generally, yes, but month to month is not a lease.

    But are you talking renewing an expired lease or a new tenant?

    Why was the person allowed to move in before they signed the lease.
    Or is this a new lease to replace a old expired lease.

    But if the party did not sign the lease , it is not valid.
