Wrong date of last activity reported
The original creditor is not reporting the correct date of last activity. My last payment was 12/2002. (I never ever made a payment past this date!) The o/c shows a payment on my account to bring the account from in default to current back and again. They're reporting it as current(ok) up until 10/2003 then in default and then current again all the way to 2005, then finally into default and cash-off. (I don't want to get into details here. I can illaberate later if need be) It has been in collection for many years and my current credit reports just show a cash-off. I have reformed from disputing this with the CRA's. My plan is to write the CRA's to get the compliance dates only. Not to dispute, but to just get the compliance dates and go from there. This will be beyond the SOL for my state in 1/2009 but according to them it's still well within the SOL. I need to get this cleared up. Not sure quite how to handle this.

Is this in suit or are you getting phone calls or is this just about your credit report?

You can report disagreements and discrepancies to the credit card companies and they will review your documentation and possibly correct your credit reports.

Keep in mind that according to you you are one month from being out of Statute for a lawsuit - if this isn't in suit right now do you really want to bring it to the creditor's attention?

Of course, if they have some sort of proof that the last activity was 2005 - or whatever they show - Statute isn't going to matter because they will argue they are within the Statute.

No, this is not in suit, yet. Go here Reaging Information - General Credit Issues - FICO Forums check this out, this is what I want to do.

If they do have any proof they'd be proving my case. I have proof. I still have all the statements showing when it went into default. However, on the 8th one after being in default their showing a F/C adjustment (I don't know what that means) and a late payment fee adjustment. I'm sure, this is their way of recreating the DOLA. If I wait a few more weeks to start this process then it's past the SOL by my proof.

First of all, why should I leave myself open for a lawsuit by letting them illegally report the wrong DOLA. Secondly, this would also let them illegally keep it on my credit report longer.

They don't prove their case until they get into Court.

To answer your question, I don't know why you'd leave yourself open for a lawsuit. I also don't think - if you are within weeks of the Statute - you have enough time to head off a lawsuit.

I don't know who sponsors the site you have posted or who answers - or their qualifications. If it contains the answer you want, though, go for it.

Can a company put late payments on your credit report for the wrong months? Have cancel checks of theses months that they say I am 30 days late.
