Eligible probation
Okay my husband was convicted of three agg robbery charges also with probation violation. He were on 4yrs defered probation for theft(1500) which was a misdemeanor. The prosecutors indicted him with first offer 20yrs. I want to know since he doesn't have a background is he elgible for 10yrs defered probation or a plea bargain.

Does not have a background? What is the previous theft he was on probation for.
First he will have to answer to the probation violation which has nothing to do with the sentence from the new crimes, He is almost for sure to get some prison time for the violation.
Also with it being three robbery, I doubt they will go less than 10 years at best.

He was on probation for a theft of a school computer.

How can he get a plea bargain? Have him talk to his attorney. The attorney will then contact the DA and discuss a possible plea bargain arrangement.

Do you think he's able to get ask for 10yrs defererd probation? Or tell him to get a plea bargain?

Only his Attorney knows all of the circumstances and the legal/Court climate in your area. So far it's all been good advice but from here it's guessing.
Why don't you consider the prior theft to be a criminal record?

His attorey or the DA will mention a plea agreement, on 3 felony I would guess a plea of 5 to 10 years in prison as a possible offer. I dobt that any plea will not include jail time

Best suggestion to gauge how things will end is to research similar cases in your district. But ultimately it will be up to the DA, the current court load, the current jail/prison population, whether the DA's wife is in a good mood etc...

You're mixing up apples and oranges... IF he's eligible for some sort of 10 year deferred probation program, he'll most likely only get it as a RESULT of a plea agreement. If he goes to trial and loses, he's probably not going to get probation, EVEN if he's eligible.
