    Will I get a shoplifting summons in the mail?
    Hi

    I was caught shoplifting at Walmart in Ontario. They called the police to verify whether I had a record. It came clear. The police were NOT called to the scene. I was given the notice to remain out of the store and I was given a letter "Notice of Apprehension" It says I had been detained for theft under $5000. The unmarked choices said "Farud...." and "Possession of Stolen Property. Under this one it says a Criminal Summons will be obtained on that charge" Then my rights and warnings. Then I was let go with some comment about the Police sending me a letter with either a warning or a summons.

    I called the appropriate Division and they new nothing of sending a letter or summons if they did not attend. They said it was probably part of the required paperwork.

    Am I going to get a letter in the mail from the police??

    Your best bet would be to contact a lawyer. Outside of that, go in person and ask to have as it down with someone about your situation and if there are any outstanding charges against you.

    There are no outstanding charges. Can they involve the police when they were not called in the first place?

    They can file a complaint against you with the Police at any time, within reason. No way to know if this is a scare tactic or if they are serious and are going to file against you.

    I do know the WalMart in my area - in the US - has a "no first chance" policy. You get caught and you get arrested, not necessarily that same day. They do not involve the Police but Security goes to the Police Department on another date, provides the Affidavits and any other proof, and files the charge.

    How long ago did this happen - if you gave a date, I don't recall -

    Yes, they can take this to the police and file a charge, you will be sent a letter giving you a day and time to report for photo and finger printing, an then latter a letter on a court date.

    This is why I contacted the appropriate Division (police). The event happened yesterday. The discussion at the store with Security was along the lines of me not wanting it delivered home and could I pick this letter up? They gave me the Division phone number and said ask for front desk. I did and the Officer asked around and they all came to the same conclusion that they have never heard of them sending a letter out. Could it be the word "letter" that is throwing them off and not using the word summons to make it clear?

    Who decides if I am to get a warning or charged. This is what security said are the two possibilities.

    It's anybody's guess if they were scaring you or using the wrong word - letter instead of summons. The fact that they didn't back down but instead told you to call the Police would indicate to me (at least) that they still may ask the Police to charge you but just haven't gotten in to file the paperwork yet. They may only file once a week.

    I'm not in Canada but it's my understanding from other people who have posted that you get a letter telling you to come in for printing and photos and they hand you the Summons at that time. May not be the same in all jurisdictions.

    The store will make the decision whether to file with the Police; the Police will determine whether there's enough evidence to charge you.

    Even if you pick the Summons up further correspondence concerning Court dates and adjournments, etc. will be by mail -

    My huband & I caught by walmart security of shoplifting of 12$ they given us a notice of apprehension it was our first offence then what they will do after that they will charge us a criminal court or civil court.I give us suggestion. I am in ontario

    To the best of my knowledge Walmart's policy is to always file criminal charges. You will get a notice in the mail to make restitution - pay for the merchandise and their time and trouble - and a notice to appear for photos and fingerprints.

    If you qualify you will participate in the diversion program and "probably" be ordered to say out of Walmart (or be arrested for shopliting) and have to pay fines. You may be placed on probation.

    Walmart is tough.
