I am 31 years old father of 2 children with my girfriend of 10 years. In the past 6 months she has tried committing suicide and was arressted for domestic violence against me and my oldest son of 13 years old. She is keeping my children from me now going on 5 days since she was realeased from jail and does not answer her phone or allow me to see my children. I have custody of my other child from a rpevious marriage. What are my options with her past do I have a chance to get full custody of my 2 children.

I think you do. What you need to do is file a petition for an emergency change in custody. Bring the police/hospital reports about the domestic violence and suicide.

In all likelihood the judge will issue an emergency order and you can then take that, with police escort and take custody.

Yes, you should file an ex parte asking for immediate custody and no visitation to mom. And you'll probably get it. Attach copies of anything documenting the dv or suicide attempts or threats, etc.

I'd do this ASAP. This is not something to sit around and think about for too long.

I should have also stressed that you need to do this immediately, like first thing tmmw if you haven't started it already.

The longer you wait the more questions as to how urgent this is to your will arise. Not to mention the danger the kids are in.
