    Can't get a straight answer about receiving my deductible back
    Hello,
    In Feb my car was hit by truck while waiting at stop light. My friend borrowed my car to go to work so I was not in the car.

    My Progressive insurance claims I am not at fault but the other insurance company is fighting it. I am not charged extra for my insurance (it's not my fault in their eyes - I was told by a representative), so why I did pay the 1000 deductible? And why have been working on getting back for over 6 months?

    Two months ago I called to see what was taking so long and they said they were taking it to a third party "court" to review the case which was scheduled for Sept 5. Great, so I waited until this date and I called last week they didn't have an update for me. So I contacted them again today and they did not review the case on that date and now I have no date and it is still open but will be reviewed as soon as possible, when ever that is.

    I don't know what else I can do. I feel like they are not taking the actions necessary to retrieve my deductible back in a timely matter and I am just getting pushed aside, and I fear I will have to pay this deductible because they will never fight this and get my money from the other drivers insurance. Is there anything I can do?

    It depends on how stubborn the other insurance company is. It sounds like in your case, the other company is absolutely refusing.
    Your insurance company will NOT pay you back your $1000 deductible UNTIL they get the money from the other company.

    Thanks, that is what I was afraid of and have already been told that by my insurance company. I really want to know what I can do to make sure that this is getting taken care of. I mean I expected this to take weeks/couple of months but this is going on 7 months.

    I read somewhere about taking the person that hit you to small claims court for the deductible. Would this be an option if my insurance company is unable to recover the money? Even though I wasn't the driver it is my car and I am the one who paid the deductible expecting to get it back once the paperwork was done.

    I was involved in an accident a couple of years ago where I was the first car in a line of 4 cars. It was a chain reaction... the 4th car rear-ended the 3rd, the 3rd hit the 2nd, the 2nd hit me. It took about 8 months to get my deductible back because car no. 4's insurance co. was arguing that it wasn't their fault. But I eventually got it.

    Hang in there. You'll get it. Hopefully it won't take much longer.

    You can not take it to small claims court unless the other company completely denies the claim. Other wise it is just a waiting game. Your best bet is to just keep calling the adjuster. If you can not get a hold of your adjuster call your agent. Sorry to say it is a waiting game. I am a licensed agent in Ohio. For future if you are ever in an accident like this (hopefully your not) put the claim in through the insurance company that hit you this advoids the deductable problem. When you exchange info the insurance info should also be exchanged. And it is easy enough to call and put in a claim with they other parties information. The insurance companies will always verify the information before processing any claim so make sure you have the police report number at the same time. When you call your own insurance it may go fast but it does come out of you pocket first. I hope this helps and hopefully you get your ded back fast

    Hello all,

    I received my check in the mail yesterday :) On the check it states the date on the incident 2/28/08 and the date issued on the check was 10/15/08. So it was just about 8 months today.

    Wow that was a long time and LisaB4657 told me to hold out a little longer which let me relax about it, but still you never know which way it could go.

    I love this community for answering my questions on various subjects and I figured I would post the conclusion so possibly this can ease someone else's mind if they are in a similar situation.
