    Lawsuit Flop
    Back in 2001 my mother was in a car accident, she was taken to the hospital for a broken neck and received surgery. When my mother was in recover the nurse was not watching my mother and overdosed her with morphine. Which has now caused permanent short term memory loss.

    My mother went through years of rehabilitation to finally be able to take care of herself starting last year. Because of her disabilities she can not mentally hold a full time job (even a part time job is VERY difficult for her) She requires a lot of sleep and naps occasionally throughout the day which of course most jobs don't except.

    We started a case against the doctor and the hospital giving this information on a GOLDEN platter to the lawyer. All the information proving this happened while in the care of the hospital.

    In 2005 our case was denied by our county court and our lawyer appealed it to the Supreme Court. Now it is 2008 the lawyer occasionally gives my mother a thousand here and there. Since 2005 after trying persistently to talk to the lawyer which is VERY DIFFICULT to do. He NEVER returns emails, phone calls, etc. The only way to talk to him is by waiting at his office until he shows up. For him to say everything is going great and we should be hearing something soon. He said that to my mother last month.

    After several times of trying to find out ANY information which the lawyer always denies her for. She called the Supreme Court office and wanted a status on her case. They ended up telling her that it was denied back in 2006 because of "bad" paper work given to them by her lawyer.

    It has been 2 YEARS!! And the lawyer is still telling us the its in the bag. Is it possible to counter sue the lawyer for his neglengance to this case.

    This wasn't money that we were trying to just to go crazy and spend it all. This was money to pay for her never ending medical bills she will have for the rest of her life. To help support her since she can't keep or get a job. My mother has lost everything because of this accident. She lost her job, her husband and now any future assistance that she was counting on. I just want to make sure she gets something to help her.

    Get yourself to another attorney immediately. You may be able to get the case reopened and it sounds like you have a good malpractice case against the current attorney. But you can't do any of this until you speak to another attorney. Don't wait!

    The attorney you had sounds extremely incompetent and can be held under an attorney malpractice suit. Sue him and get another attorney immediately to try and refile the original lawsuit. Your mom's original case with the hospital may be out of the statute of limitations.
