    Personal indemification on surety bond
    Eight years ago I was president of a construction firm and had to have surety bonds to do the work I performed. Obtaining a performance bond required my wife and I to sign a personal indemnification agreement with the bonding company. After I went out of business and retired one job had some warranty work done and the bonding company paid someone to perform this work. The bill came to $18000.00 and they sent me a summons to answer within twenty days wanting my wife and I to pay for the work. We are retired with no income other than social security. I do not plan to answer the summons but my question is can they file a lien against my homestead for payment?

    Depends on where you live
    Do you have money in the bank, they can freeze the bank accounts

    Thanks for your quick response. I live in Minnesota and do not have any savings accounts other than a small personal cchecking account. My wife has a SEP Ira which I am sure they cannot touch. It is not a big amount and I did check with my accountant before I went out of business and he told me that account and social security cannot be touched.
    In the event they were to file a lien on my homstead could you tell me the procedures they must follow.
