    Who can be evicted
    Can only one person from a family be evicted or does everyone have to be?

    My family and I have been living in this apartment owned by my mother for 12yrs. And now she wants my husband out because she is upset with him. We have made a few rent payment through the years but nothing much was said.

    She has to evict you both. She can then invite one or the other of you back.

    This question sounds very familiar. Are you sure you didn't ask it before under a different name?

    But the answer, then and now, is no, one cannot split up a family by evicting specific members.

    Yes, but in many States between Nov 1 and Apr 1 they have to give you an additional month's notice. I'm a landlord - if this were the law I would get no rent during the Winter and everyone would move in the Spring.

    Well in actual fact you could evict one family member but the problem is that the other family member could invite the other back in right after that.

    So to really get them out, you will have to evict all of the family members.

    Some states it is harder to to evict a family with children but it can be done, it may just take a little longer.
