    Contempt of Court if you are pregnant?
    I have custody of my two children with the mother having supervised visits each Saturday for 4 hours. I had heard few months ago that she was pregnant with her fourth child but she just confirmed it by telling our children finally last weekend that she was 4 months pregnant. To make a long story short, she is ordered to pay child support to me but basically refuses. I have had the children for over 4 years and she has only made 2 payments. Up until recently I didn't push it because I had the means to provide for them but I was recently laid off. She has been held in contempt for non-payment twice already and owes my lawyer court fees for that as well. It has been about 4 months since she was last placed in contempt and I still haven't received any child support so I was about to start proceedings again. My question is this: will a judge not place her in jail and order a purge payment (that is how I received money last time) because she is pregnant? I don't believe that her being pregnant should affect the judges decision but I wanted to get advice before I proceeded. Thanks.

    How will putting her in jail enable her to make support payments? There are agencies that will garnish salaries to cover support payments. You should be contacting them.

    The last time the judge placed her in contempt he placed her in jail until she came up with a small purge payment of $500. She was out within a couple of hours and I finally received some sort of child support. She is a very good manipulator. An income deduction order is in the child support paperwork but she rarely holds job for more than a few months and she is never tells her employer to deduct her child support from her wages. By the time they catch up to her she is usually fired or quits volunatarily. She works under the table and claims she has no income. This is the only way I know of to receive a CS payment is through a purge payment unless anyone else has a suggestion.

    Nope, but it sounds like the judge needs to order her kept in jail until she makes up a more significant portion of the back support.
