Adult child eviction laws in Missouri
I am divorced from the 18 year olds father. They all still live with me since the divorce. It is my home in my name only on the title. The 18 year old does not contribute to the rent or pay any on the utilities, seems to think he is the boss around the house and should not have any rules. He is very this respectful to me and his father. I want him out and he says that he is entitled to a 30 days notice. I was wondering if you could help me out here. My home is in Liberty Missouri. Does anyone know the laws out there for a situation like mine. His father is unemployed and I am the only one who pays the bills here. Thanks

    Hello b:

He IS entitled to 30 days notice. Make it writing sent to him by certified mail, return receipt requested. Send another copy by regular mail, and hand him another. If he doesn't leave, you'll have to go to court... But, he'll probably leave when he gets notice.

He will have to be given a notice, if he was suppose to pay rent, and did not pay, you may be able to give a shorter notice, but yes, he has to be given notice to move, and then if he does not move, takent to court to be evicted.

Missouri law says a child is an adult at the age of 17, and they can leave home if they choose, however (here's the catch), a parent cannot legally keep them out of their home if they want to return or stay there, not until they are 18, when they become an adult in Missouri for the second time. Also, until they turn 18 the parent is responsible for their health, welfare, and well-being, regardless if they live at home or not, and they are still under DFS jurisdiction. Finally, in Missouri a child becomes an adult for the third and last time at age 21.
