Removal of felony
Hello,
I was charged for stealing a controlled substance for a pharmacy that I worked at. We pleaded not guilty in court and came to a mutual agreement regarding charges. I thought after my probation it would be removed or sealed however, it showed up during a FBi fingerprinting. It happened in October 1993. Is there anything I can do to get this removed or sealed and if it showed up during fingerprinting does that mean it will come up during a routine background check if they look back that far.

You would have to hire an attorney and get an expungement of this crime from your record. It usually takes about 6-8 months for the paperwork to go through and the Judge to sign the Order.

Ok, you originally plead not guility, but came to a plea agreement and changed it to guility in return for a specific agreed sentence.
Yes it will be on your record forever but you can make a motion with that court to have it explunged.

What did you actaully agree to back then? Whar shows up when they run your prints, exact wording? Does it only show from the FBI and not the state or any other agency?

You can have it expunged, it doesn't take an attorney. You can call your clerk of courts and they will send you the paperwork, or they can tell you how to download it. It costs around $50.00 and it takes about 4 months. If you use an attorney, they fill out the same form and charge you way more than $50 to file it and it still takes 4 months.

It's a little funny to think about the last situation I dealt with at work. A new employees prints came back with an arrest for a drunken brawl in Fort Lauderdale. The kid explained that his conviction was expunged, apparently his arrest record was not.

The various States have different rules when it comes to expungement. What State are you addressing?

Yep you are probably correct... that was what happened in my particular case.. it was fairly easy. I suppose every state is different. But it wouldn't hurt to call and check it out first.
