    Eviction of inlaws from property
    My wife and I are separated and my inlaws live on the land we are staying on. The land is my brothers not mine or my wife, but I have the power of attorney for the land while my brother is away. There is no lease or rental's agreement. They own the mobile but not the land. The utilities are in my name not theirs. How can I get them to leave?

    If at all possible, start by asking. Then I would imagine you can use the sheriff to have them removed as they are not guests that are welcomed and at that point trespassing. However, if at all possible I would start by asking and constructing a nice letter requesting with in so much (Resonable time) they take their mobile and vacate. Sound do able?

    Hello taz:

    They're tenants. Even if they pay NOTHING for ANYTHING, and you have NOTHING written, they're still legally considered tenants. Trespassers don't bring their mobile homes with them.

    Therefore, you're going to have to evict them according to the landlord/tenant laws of your state. We have a copy of them at the top of the real estate page on a "sticky note".

    That's one of the best straight lines ever - trespassers don't bring their mobile homes with them.

    Okay, now that I've got it back together again, right. They are tenants and have to be evicted according to the laws of your State.

    Do-able but not legal - they have to be evicted. Wouldn't hurt to ask but the Sheriff is not going to just come and remove them.

    As already pointed out you would have to formally evict them. What state are you in? Each state has different times for the proceedings but basically if they don't leave on their own you will have to go to court.
