    Evicting Adult Child from Parent's Home
    I have an adult, who is 23 years old, he is the half brother to my 2 natural kids. He is an alcoholic, no longer has a job and he spends his days at friends house even though he claims he is out job hunting. He does not have any money to pay any bills, rent or for any food. He has come into my house several times staggering drunk, he has been very rude and disrespectful towards both me and my husband. I have called the police and I was told I had to give him a 30 day notice, so I typed up a 30 day notice, but when the time came he refused to leave. I called the police again but then they informed me that I need to give him a 30 day notice on legal paperwork through the Sheriffs Office. I am getting the run around because the Sheriffs office said that I have to actually get a lawyer to do what is necessary to get him out of my house. All I want is him to move out of my house. How do I get him out of my house?

    Where are you? In Nevada you would go to the court house, pay a fee to do an eviction, which will be served by a Sheriff on him (this is what the fee is for). At the end of the 30 days both would have to go to court and the judge will award the eviction. After that when you call the police they can remove him. Until that legal process is done his presence is considered a civil matter. I would, if I were you, go to the court house with the 30 day previous eviction you have done because in some jurisdiction they will allow an eviction to be done in a shorter time, like 1 or 2 weeks for the court date. You are not getting the round around and you can do it yourself without a lawyer. Easy way to find out where is call the Attorney General's Office in your state, tell them where you are (county or city) and ask what court you would file an eviction. They will tell you where, go there and ask the clerk how to proceed they will walk you through it.

    You have to follow the legal requirements of your State in order to evict him - I have never known the statement that you need an Attorney in order to evict to be true.
