    Judgement Debtor for Credit Card Debt
    I live in Florida I just got a letter from an attorney telling me that I am a Judgement Debtor for a credit card debt. They are treating me, they kept on calling( I don't answer). I don't work, the house is in my husband name I am just the benificiary, we have a joint bank account. The debt is about six years old. What is the Statutes of Limitation in Florida for a credit card debt and what should I do?

    If you are a "judgement debtor" that indicates they ALREADY obtained a judgement against you. So the SOL doesn't apply.

    If you are listed as the owner of any asset (bank account or physical asset) they can attach it.

    So you first need to find out whether they do have a judgement or whether they are initiating suit.

    How could they get a judgement againist you without your knowledge? You would have had much more written communication prior to them going to court to seek a judgement. Just because they refer to judgement debtor doesn't mean you are one yet. Like Scott says, llok into this matter to see if there really is a judgement already. If there is no judgement then the SOL has run out (5 years) and you can't be forced to pay.

    As we've seen here there are lots of times when a judgement is handed down without the defendant knowing or recalling. They ignore any correspondence or never get it because of having moved around a lot. Collection agencies fudge service and more.

    Even if there wasn't a judgement, there is no guarantee SOL has expired. We don't know the last activity or when the suit was first filed.
