    How to get power of attorney
    My Niece has been institutionalized with Alzheimers. I am the last living relative and have been asked if I want to have power of attorney.
    1. I don't know how this is done. I've Googled it but it only tells how I, me, myself can give power of attorney to someone else, not how I claim it. So how do I receive it?
    2. My Niece lives in a home for those with Alzheimers or Memory Loss, to put it kindly, in Boston, Mass. I live in Tucson, Arizona. This is a sticky situation as I can't be flying back and forth Tucson/Boston. Is it possible to have the power of attorney and live so far away and communicate only by phone, emails, etc.

    I would first suggest you contact a family law attorney in Boston. Laws can differ between states. In my state, it would be necessary for you to go to court to have your niece declared legally incompetent and be appointed as her legal guardian in order obtain a POA.

    Its too late. One needs to confer POA on someone why they are still in full command of their faculties. You can't take POA, it has to be given.

    Its possible the home has POA and wants to confer it on someone else. Otherwise you would need to be appointed her guardian so you can make medical decisions and sign legal documents for her.

    Once this has been done, you would not need to travel to Boston, documentat can be dielivered by overnight messenger.

    POA has to be signed by the other person, you will have to go to court for guardianship at this point
