    Probation
    Can a Parole Officer drug test someone if it is not a condition of probation. I live in Maine where medical marijuana is legal, I am not actually prescribed marijuana but am prescribed marinol, a synthetic thc. I know that with a simple drug test(urine) they can not tell the difference between the two, but with a more expensive test(gc-ms) they can. I would hate to lose my prescription or go to jail, and was wondering if it is legal to test someone if their probation conditions do NOT specify that as a stipulation.

    Hello again, fuzzby:

    While on parole, you are technically still a prisoner who happens to be serving the last of his sentence on the street. Therefore, you are subject to search. I don't believe a defense that it wasn't a condition of your parole or probation will fly.

    Next. In terms of your medication, it would seem that your family doctor would be in charge of that. However, being a "prisoner", the Department of Corrections is in charge - NOT your doctor. Consequently, prescriptions must be approved by your PO.

    If you haven't done so, you'll be violated EVEN if they confirm that it's marinol, and not the real stuff.

    You need to inform your PO of your prescription just in case you are subjected to a drug test.
