    E3 to B1 back to E3
    Hi

    I was terminated from my job (under E3 status) with no notice. I am still in my 10 day grace period and I want to stay here to find another job and go back to the E3. However, since I'm not going to find a job in 10 days, I don't want to violate any terms of my stay here so I am transferring to a B1/B2 tourist/business visa until I can find something, or go home. I want to know if I necessarily need to do this as I have been told many things including: As long as my I-94 is valid I can stay and look for work. Does anyone have any advice or information for me? My number one issue is being kicked out of the country in a small amount of time or to stay here illegally. Also, can you transfer from a b1/b2 back to an E3?

    Though your I-94 is still valid but your employment contract was terminated, so you are already out of status. The chance to change your status from E-3 to B-1 is slim since you would need to submit the application 60-90 days in advance. If you're out of status longer than grace period, you will be ineligible for any employment visa in the future.

    The best choice for you now is return to your home country within 10 days and find a new job, apply for a new visa.

    Thank you so much for this information. Will there be absolutely no chance for me to obtain another employment visa in the future, since I was terminated with no notice?

    By the laws, you must be notified in case of termination of contract. Contact you employer and ask for this document. Anyway it does no harm to you unless termination was made based on allegations or you're charged with fraud, etc.
