    No custody
    I am a woman. I had a kid at 16. I went to prison and children services took my kids and gave custody to the grand father on the fathers side. Thefather is not around and owes the grandfather child support. I just got out of treatment for my drug problem and trying to get my life togrther and now the grandfather wants childsupport. He has had them for 4 years. Icant afford the child nor can I afford child support. Am I obligated to pay? Hasn't my rights been terminated what am I to do? Please help!

    If they actually terminated your rights including child support (adopted) you do not have to pay but most probably they terminated your rights but not the support. If he goes to court and goes after you for support then you will have to get a job and pay the support.

    Unless your rights were terminated - you will have to pay Child Support to the caregiver (their grand-father). You would have been notified if they terminated your parental rights. There will be a court hearing to set a Child Support order. They will take a percentage of your income, or if you are not working, they will set it at a dollar amount based on minimum wage.

    I understand when you say you can't afford to pay it... however - this is your obligation to support your children... I'm glad you got cleaned up and are getting your life on track - that will be a valuable lesson for your kids... don't begrudge them what they deserve... they've already been served a bad deal and have to live with the fact that their biological parents aren't able to care for them - thank God for their Grandfather!

    It is common for the mom or dad of a child taken by CPS to have to pay child support.
