    Child Support/Visitation
I currently reside in Massachusetts and my daughters father resides in Brooklyn New York. I am considering taking him to court to have child support ordered. I know once I do this this will make him very angry and to spite me he will file a motion for visitation. Is there something I can do before hand to protect my daughters best interest? It's not that I do not want him to see her, it's that she is young and he is living in another state and I am unsure of his current living situation

You need to find out his living situation and present to the court why overnitght visitation would not be itnhe best interests of your daughter. I strognly suggest getting an attorney to assist you.

    Get an attorney.

Just know that you can't stop him from seeing his child if he wants to. And as you live in different states it will most likely be overnight visits, at least at some point. On the other hand if he is getting visits to mess with you and he doesn't really care about seeing your daughter then it won't last long -- it might not even start if you don't fight it and take the "I wish he would see our child, it would give me a break." frame of mind.

And when it's in another State, not just a "drive by inspection," it's a good idea to actually hire someone to do a background check, ask some questions.

Costs money but you'll get a professional report prepared by someone who knows the law, knows how to phrase what is found, knows what the Court wants to see.

Here is a question you need to ask yourself why would you deny the father his visitation rights.

I read the post to say that the father has had little or no contact with the child, the child is very young, the mother is concerned because visitation would be out of State and she is concerned about where/how the father is living.

    Brianna - am I right?
