    Am I a non-resident alien
    Hello!

    I'm on OPT now and am filling out my W-4 for a new employer and want to know if am considered a non-resident alien. My opt expires aug 2009. I will be on H-1 by oct 2009. For tax purposes does this affect how much that's withheld.

    Will I be an advantage if I file as NRA or not.

    Yes, for 2008 AND 2009, you will be a non-resident aslien if you are single.

    If you are MARRIED, you can file jointly in 2009 with your spouse and you BOTH coose to be treated as resident aliens.
