    Right to upgrades as a tenant
    We have been living in an apt for 5 years and recently our neighbors, who have lived here less than us and new tenants moving in, are receiving new appliances, wood floors and fresh paint job. We pay.. the same if not more than most these neighbors and still have not.. and may not receive any upgrades.
    Do we have any rights to these new appliances?We have a yearly lease and never receive the same treatment as others here.

    I don't see that you have any rights. There is no law that all tenants have to have the same appliances, same "new" paint, whatever other problems there are.

    Some of my units have new appliances because the old ones were not working and some have paint because there are new tenants and I paint when a new tenant comes in OR the old tenants asked and I agreed.

    Have you asked for upgrades/upkeep?

    If you are being routinely discriminated against, you can look into that but that usually concerns only the ability to rent, not new appliances.

    What you have a right to is what's stated in your lease and what conditions you agreed to when you moved in.

    You also have the right not to renew your lease when it comes up for renewal. Just make sure you give the proper (30 days or whatever) notice to terminate your tenancy.

    That said, I understand your frustration. Have you tried talking to your landlord about it? Explain to them that it's rather frustrating for you to have been good, long-term tenants, but yet you must sit by and watch brand new people move into upgraded units for the same price or less (make sure this is a fact before you throw it in their faces). Would it be possible for you guys to receive a few upgrades, as well?

    You have no such rights unless they are in the lease,

    You do have the right to ask for them, and when it is time to renew the lease refuse to sign one unless you get the upgrades.

    Some areas do dictate that apartments be painted on a regular basis. You need to check your local housing laws for that.

    But as long as the appliances are working, then you aren't entitled to an upgrade. If the landlord is paying for utilities, you might suggest that newer, "green" appliances will save him money.
