I have a debt of 100k
I have a debt of 100k as a result of being a victim of fraud. Basically what happened was cheques of very large amounts were deposited into my bank account by someone I thought I could trust. I did not think the situation over well and did not ask any questions I just withdrew the money from my account and sent it where I was told to. I assumed the cheques were good because the bank released the funds, but 30 days later I find myself down 100K. I reported what happened to the police and show all the evidence of where the money was sent. It’s been two years since this happened and I have not heard anything for the police. I checked my credit report online and the outstanding debt is on it. So my question is can the bank file changes against me? And even though I withdrew the money does the bank not hold any responsibility for what happened? Why didn’t they hold funds? And if I file for bankruptcy will that clear my debt? Only reason the bank has not start to garnish my wage is that I now live in Japan.

If you chashed them from at your bank mae the depositsd there and withdrew the money then it is your responsibility it was your account and you withdrew the money so it is you that would need to apy it back and don't know if you can file bankruptcy on this as you live in japan not sure how it works there I would check with a lawyer that deal with this in your country and just a question did you know this perosn personiley? Or was it someone you ahd meet over the internet? It sounds like it was fraud this happens all the time with people being sent money to deposit and then send them the cash never ever trust someone that wants you to cash checks for them and then withdraw the money to send to them

Who do you owe? The bank? Someone you could trust? Someone else? When you withdrew money from the account, how did you do it? First, you are up $100k; then you are down $100k; sounds like you are 'even' to me.

Hello help:
This is called the Nigerian Check Scam. It's as old as the hills, and blows me away every time I hear somebody new has been caught up in it. Yes, you owe the money. Yes, bankruptcy will stop them from collecting. No, you probably won't face criminal charges.
excon
PS> Come on, you can tell us the truth. You didn't do it because you TRUSTED somebody. You did it because they promised you a BIG CHUNK of the money if you would only send them some. The scam worked, like ALL scams do, because of your GREED, not your TRUST.

As soon as I read this, I thought Nigerian Check scam. I totally agree with excon. In fact, I was reading an article just yesterday where Nigerian officials are putting some of the blame on the victims. And I agree with them. I've read many of the scam letters and they all look shady and appeal to people's greed.
It's a wonder anyone falls for them.
You are lucky you aren't being prosecuted for fraud, but that may be because you are out of the country. There may be a warrant out for your arrest.

You and excon are right but it wasn't greed because I wasn't promised anything it was just stupidity to think I could trust the person. Anyway this happened 2 years ago and I've been back home twice since I've also received a letter from the bank saying what I own them and that I must pay it before a certain date. I've reported the situation to the police in person shortly after it happened. So I hope I'm not being prosecuted for fraud or I hope there isn't a warrant out for my arrest. Thanks for the feed back
