    Hello kahnofman

Please first explain why you want to get your husband legally out of the home. Note you wrote "our" home! Not "your" home. Did you already start divorce procedures? Is there any physical threat involved?

    Hello k:

Go to court and apply for a restraining order. That'll keep him out of the house while you file for divorce.

Of course, if he's not a threat to you, that's not going to work, and I wouldn't lie. He just might have to stay until the divorce judge tells one of you to leave. Depending on several things, it might NOT be him.

Only a court order will get him out of the house. You need to have an attorney consulted about this problem.

First most likely unless he has phsycially tried to hurt you, you are not going to get him out today If you have enough evidence to get a restraining order, do so and get him removed pending a hearing on that.

But you are goig to have to file for divorce, and fight over ownership of the house.

Our home vs your home doesn't matter - it's the marital residence.

If he's violent or threatening and you can prove it, get a restraining order. In my area that has to be followed by an eviction. Sounds like one should take care of the other but that's not necessarily true.

If you don't have grounds for a restraining order you have to file for divorce, come to an agreement OR have a Judge make that decision for you.

Nothing will happen in the immediate future, let alone "2day," UNLESS he is a physical danger to you.
