    How much time?
I am currently on probation in N.J.. My original charge was a disorderly persons, I got one year of probation. The last month of that the year came around and I got violated for not going once, the extended me for an extra year but I did not go to court until April. So in reality I got A year and four months extra. Now I violated again, I'm giving dirty uriine for 2 months straight. My question is can I just serve all my punishment in jail and come out to no probation? And what is the longest I would have to do?

    Hi, dfresh!

None of us here can predict what a judge who hears your case will say. If your talking about urine tests not turning out favorably, have you thought about acting in a way where things will turn out for you favorably without violating probation and following all of the rules that you are supposed to follow?

You have asked a question here about something that has a great affect on your life. A good part of life is about the choices that a person makes, the cost and benefit of making those choices and dealing with the cards that you have been dealt.

I'm not trying to preach to you, but do want you to know that I am concerned for your well-being. If you choose to want it, you will get lots of support here for the positive and proactive choices that you make for your life. There are some awesome people here who can give you great advice!

What sort of choices are you willing to make, please?

I knew of several women who had been on probation and ended up violating and being on more probation like you ended up with. They chose to do their time in jail rather than spend a year under someone else's rules. For them, it was the right choice as their lifestyle could not handle any supervision whatsoever as they were party girls. They traded a month in jail for a year's worth of probation and it worked for them.

If you have an attorney, I would strongly suggest talking it over with them and having them hammer out some sort of deal before you opt for jail time in lieu of probation time. It all depends if you can tolerate jail for a month or so to make it all worth while to you. Some people just can't toe the line and be under any supervision knowing that they will have drug and alcohol testing done. It freaks them out to do this as they can't quit the drugs or alcohol and end up doing more knowing full well they will fail.

You will be the ultimate decision maker (hopefully) because if you wait for the judge to make the decision, he just might opt for jail time and more probation time.

Ty for the info twinkiedooter. I was just wondering so about how much time do you usually do in jail to not have to do a additional year of probation? I mean I never got a jail sentence it was just one year probation, now I've been on for one year and eight month and they want me on until 4/09

As I've already asked dfresh, what sort of choices are you willing to make? Again, we can't predict here what a judge will say. Additionally, I would like to add, that we can help you here with the choices that you will make concerning your behavior so that you might not get jail time or additional probation time based upon the information that you provide to us.

    Thanks!

They can take you back in and resentence you, including time in jail. Probation was in lieu of jail time - which you already know.
