    Trying to get custody of my daughter
    I am trying to get custody of my daughter, I am going to court in less then a week and still being told by my lawyer that there is a chance that I won't get full custody of her. She has missed and was tardy a lot from school to the point she had to repeat a grade twice. Even repeating the grade she still had a lot of tardies and missed a lot of school. She is still too young to make the decision of who she wants to live with but her father is telling her lies about me as well to the point she told me she didn't know who she could believe anymore. So
    I am wondering if a clause can be put in place if I don't win a full custody case ?
    Like if my daughter misses more then 6 days of school in a semester or is tardy 6 days in a semester, that I get granted as the legal guardian parent over the other.

    You definitely need to bring the school issues to the Judges attention and I have heard of them making clauses like that. Basically it would fall under a parenting plan.

    This helps, and can you prove with evidence that the husband is telling the child lies, do you have witnesses to testify. To be honest I tell the story of the hooker , used drugs, left kids along for hours at a time with a older 12 half brother. The father a business man with a large home and family. Guess what the man lost custody case 3 separate times he tried. Women won every time, judge decided the mother was no real threat to the children, She was not at least till she latter killed herself.

    But there is never a for sure, and this may not be good enough for the judge. Why did you not have custody to start with?

    Because I didn't have a attorney couldn't afford one at the time and ex took only car so getting to work was even hard! Didn't have family help either! Was also told that I had to sign the decree which gave me very little time with my daughter it took me 5 yrs to full get all back bills paid for from that marriage and get my life where it needed to be so that I could get the life my daughter should have! I have all school records from the past 2 yrs but now ex is telling me that it is all going to be thrown out by the school truancy officers if he can proved dr statement that she went and was sick all the times that she missed school but looking at dr records she didn't go to the doctors every time she was out also got those records too.
