    Annulment Justifcation?
    My husband and I were married in May of 2006. He and I didn't live together until December of that year. However, right off the bat, he started with his disappearing acts which lead to him staying out all night. A few months later, I actually intercepted a phone call from someone that said she had been dating him for three years. He's from trinidad and doesn't have his legal documentation to be here. He told her that he married me for his papers and as soon as he received them, he was divorcing me. He promised me that he was no longer going to see her. However, he started staying out all night again. In June 2007, we moved from that location which I shared with a roommate - to our own apartment. The very next day, (father's day) he stayed out all day and did not answer his calls. When he returned home at 10pm that evening, I had his things by the door. I asked him to leave and we didn't get back together. While looking through his bank statements and his phone, I found the evidence of yet another woman. I learned that he had told her the same thing, he was only with me to obtain his papers. He is now living with this individual and the two of them are getting married, as soon as our divorce is final. She will be sponsoring him for his US citizenship or green card.

    I married this man because I loved him deeply. He was my third husband. Now that we have filed for divorce, I'm wondering if I have to be saddled with the stigma of having a third failed marriage. Can I get my marriage annulled on the grounds of fraud rather than going through divorce proceedings??

    No you will need a divorce, and it is just splitting hair, a faiiled relationship is still a failed one no matter what you call it.

    You have already filed for divorce and it is probably too late to legally change that initial filing.

    I don't see the grounds for fraud - and this depends on the State - when you learned of the fraud but didn't leave the marriage. It sounds like the marriage is ending because he is unfaithful, not because of the fraud.

    I'd get it over with as fast as possible - people make mistakes.

    No you can not get a annulment but if you do have the proof that you say you do about he onely married you for his papers then you can have him on fraud just take all the info down to the ins office where you applied and they will get ahold of him and send him back and if they can not find him thenwehn he goes for a job or to renew his work permit or when his new one goes and fils his papers to sponsor him it will all come up in the computer I went through this with one of my ex husbands he left me when I was 3 mo pregnant and within in weeks of getting his green card and went back to his country because this is wt his father wanted iw as hart broken took him back filed for him to be able to come back wich was not easy or cheap because he had left with out premsion well after spending thousands of more dollars trying to get him back here I find out 5 years later that he has a new wife and children back there and he can't support the one he has here so I went down to the ins gave them more info about him had him blocked from ever coming back to the us and he can not even travel to another country for at least 10 years I would go directly to your ins office and let them know the info you have also I know if you get a divorce before he gets his papers he will also have to return home and re enter under her sponsor ship and you can stop that from happening also I have tons of knowdgle on this as I went though it for 8 + years with one of my ex husbands if you have any questions don't hesitate to ask I fell for you and know exactly wt you are going through best of luck

    My mother married a man from Germany when she was like 78, she she concealed that fact for about 3 months cause she knew we would be upset. He wasn't a citizen and was trying to get his citizenship, the marriage was not consummated, they were married close to 10 years, with him going back and forth to Germany for weeks and months at a time. She fell and broke her hip about 3 or 4 years ago and since we did not know what we were facing, she insisted that she divorce him, which she did. Is there any way this marriage can be annulled?
