    60 Day Notice
    If I was given a 60 day notice to move out and I move out in 30 days do I have to pay for the next 30 days without giving a 30 day notice.

    Yes you have to pay for the last month you were there.
    No you don't give any notice. You can acknowledge by stating you plan on being out by 8/30/08 or whatever date

    At this point, you would owe rent for those full 60 days.

    Do you have a written lease, and does it stipulate how long the length of notice must be? (Does it have to be 60 days, or were they trying to give you lots of time?) If your lease calls for a shorter notice, I believe you could turn around and give them a 30 day.

    You can try working out other arrangements with them. It may be better for them to have you vacate sooner, and they may agree to a 30 day term. Just make sure that any agreements are in writing and signed by both parties.

    If you were to be out by August and you do not go into August there then you do not/should not have to pay for August.

    The landlord gave you a 60 day notice on May 1, telling you to be out by July 1?

    And you're staying a month past that?

    Fthat's correct, what did the landlord say when you stayed on, into July? What did they say when you paid your July rent?

    At this point it would go by what your lease says about notice and "holding over". It'll probably come down to whatever you and the landlord work out. Get it in writing.

    I read that as they got the 60-day notice on July 1st, so they technically don't have to be out until the end of August. But either reading could be correct.

    Let me make this very clear because I received several different answers. I was given a 60 Day notice on July 1 and I found a place which I moved out July 26 do I have to pay rent for August if I didn't give a 30 day notice which I didn't know when I was moving I was on month to month after 1 year of renting.

    I've merged your two threads because they are the same issue.

    A lot depends here on the wording of the notice. For example, if it says you need to vacate the premises BY Aug 30, you might not be responsible for August.

    On the other hand, if you didn't give them sufficient notice that you were vacating early, you might still owe August.

    I know you want an back and white answer, but we can't give you one because the circumstances don't warrant it.

    What I would do is not pay August and let them sue you for it and let a judge decide.
